MAN MADE ACCIDENTS – ZERO TOLERANCE

The way man made accidents are rampaging the nation, in sectors , areas and geographies, we would for sure be completely overwhelmed by it. Articles after articles we get innumerable examples of different places going the Joshimath way. They are well researched articles. Astonishingly, nothing is being done about it. In the instant case too, nothing concrete was done to stall a tragedy of this nature, crisis management of a kind which is unwarranted is the only way left in such situations. It is less of disaster management and more of a face saving. The whole system works in tandem to provide that it is not man made.

As we are operating on this mindset, we will keep on finding newer, better and innovative ways to cover the tracks of a man-made tragedy or at the very least, find ways to not to fix accountability and thus escape the legal wrath of the wrong doings. From road accidents to most of industrial accidents we are able to get to know the accused in no time. When it comes to accidents of the nature we are talking about, the word accused never finds a mention, leave aside finding them. The sections of law in the Indian Penal Code are found to be insufficient to deal with well-orchestrated human tragedies.

Intention is what criminal law works upon. It would be very difficult to find the intention missing, while the powers that be cannot see any. Intention needed always be A against B, it can also be many (vested interests + govt. functionaries + politicians) against the welfare of a town, area, community or a sector. Does it not fall under criminal conspiracy? Then what is criminal conspiracy? If we think rationally of the rot it has set in, it can legally, technically and logically be termed as a crime against the state.

As suits everybody concerned in more ways than one, no law maker, enforcer, regulatory agency or elected representative has found it worthwhile to suggest to define man made accidents by law. This would bring the train on the railway track, till now it has been travelling without a track. Criminal law will then take its own course. After a few such cases, the investigating agencies will gain proficiency in dealing with such cases. Expertise to mass cheat should be out beaten by the expertise to investigate such cheats and bring them to book. The responsive governments talk about zero tolerance in a variety of areas, at least some things move and there is lot of hue and cry. Here there is nothing.
