WHO CARES FOR THE LAWS : CERTAINLY NOT LAWMAKERS!
Given the present democratic predicament of the nation, one is not sure of the fact whether the law makers even know that their main task is to enact law. Some might know it technically but in practice they remain as far off from it as possible, to the extent that is not a part of their thought process. On the other side, what percentage of the electorate knows that they are electing their representatives as law makers and not as the executive authority of the country. The irony of the situation is that both the electors and elected feel that their role is that of the government and they can usher in development and change.
We are not getting into the debate as to how far it is from reality, suffice to say, that every elected representative keeps begging that something be done in its constituency, so that they can survive. People don’t know how the project happens and through it development, nor do the elected representatives want them to know. Herein, lies their power. This imbroglio will never get sorted out in Indian democracy and governance, as it is in the interest of everyone, to sustain this make believe world. What is a truism that everyone in the elected ecosystem does not care for the law.
This is not a reference to how they misuse the law for a variety of reasons, emanating from the political. How they are able to roughshod over the rule of law, equality before the law and the law itself is already legendary. Their tryst with criminal cases the less said the better. What is of utmost importance, is how they have messed with the legal regime, which directly impacts the quality of life and freedoms we enjoy. They don’t come from legal backgrounds, are not interested in knowing about the law; in its creation, operation or the need for change (amendment). From the creation it is skewed by design as laws are the sole creation of the ruling dispensation.
As it stands today the legislature has no role to play but to provide the rites of passage. If any elected representative has ever talked about law with his constituents remains unknown. Has law ever been initiated by the legislatures? Has there been any discussion on the state of law / legal regime in the nation? Or has it ever been discussed as what would be the legal enactment roadmap of the nation? None of these great brains have ever given a thought to the specific laws / rules / processes, which makes the life of the electorate, an endless legal struggle. Which laws have gone awry or have led to an unintended detrimental impact, has never to their thought. Correctional action is conspicuously missing. Why the right to privacy is still to be implemented after it being a fundamental right since 2017. Why is the RTI Act literally shredded? What about the Section 498A IPC (check the BNS section)? What about the faulty or non-evolving laws being a causative factor for India topping the fatal accident for decades?
