ALLU ARJUN CASE – WHO CONTROLS CRIMINAL INVESTIGATION?

The implementation of three new criminal laws was meant to be a watershed moment in the history of the criminal justice system of the county. Scientific investigation with tech and forensics was to be its, with the timelines and processes redefined and streamlined. The much touted “tarikh pe tarikh” game would get over. In the last so many months there have been lots of test cases, well known in the public domain, but the visible change seems to me missing. Who controls the police, is the biggest question and has that become the biggest stumbling block? Does the power that controls the police is interested in fair, objective and empirical investigation?

Supreme court directives to reform the police around two decades back to the newly introduced criminal laws, nothing has been able to make a dent in the prevailing system. The mindsets, attitudes and expertise all remain the same but for a few superficial level tinkering. At the most some gloss would stick at the maximum in the initial stages. The Allu Arjun case taking media centre stage is a manifestation of quite a few things which ails both policing and the criminal justice system. So everything remaining the same, the new laws even if taken as reformist, futuristic, Indian and making India future ready in criminal investigation cannot taking roots,

In the Allu Arjun case, from the beginning to the end, but for criminal investigation everything has prevailed. First is the nature of control over the investigation, it is for sure outside the top echelons of police, we don’t even know who is the investigating officer, when as per the law, he directs and defines the investigation to unravel the truth and with appropriate evidence, places it before the court. Nature of the communication gaps between the police and the superstar and cinema hall management has become the centre of this investigation. The state; government and police have already expressed their mind and so the narrative is cast in stone.

Have criminal cases become tools of political slugfest? Or has it been the same over the years? It has landed in a mess which puts a big question mark on the investigative skills of the police, or its ability to fully bend backwards or both. In a homicide case not amounting to murder with this nature of scene of offence, and ready availability of all the wherewithal required for investigation, the end of the case still seems to be far off. A trial even before the investigation. Can you imagine, the case now revolves around whether Allu Arjun was aware of the police not approving of the event and when did he come to know of the death of the lady in the stampede. His appearing through the sun-roof is directly related to the stampede death as per the police. Has this investigation become a battle between an incumbent Chief Minister and Superstar.
